Right to access your personnel file

Many employees wonder what exactly is kept in their personnel file. The good news: under Article 15 of the GDPR, you have the right to access your personnel file. This file typically includes your employment contract, performance evaluations, diplomas, and correspondence about your functioning.

Not only can you view your file, but you can also request a copy. Your employer is legally required to comply with such a request and provide the relevant information.

Not all information must be disclosed

Be aware: not everything in the personnel file falls under the right of access. Personal work notes and internal memos intended solely for internal consultation or discussion do not need to be shared. Emails from colleagues that mention your name are also usually excluded, in order to protect the privacy of others.

An employer must weigh your right to access against the privacy rights of third parties.

Right to correct your data

In addition to access, you also have the right to request correction. If your file contains factual errors, such as an incorrect date or misspelled name, you may request these to be rectified, supplemented, or restricted.

However, if the issue involves a negative evaluation that you disagree with, you generally cannot have it removed or altered. Instead, you have the right to add your own written response to the file, ensuring your side of the story is recorded.
